We have received a number of requests from members asking how to proceed with public meetings and public hearings as required by statutory time frames as we all respond to the COVID-19 pandemic.

First, we recommend you call your local health department for their guidance on public gatherings or contact the Montana Department of Health and Human Services.

Next, contact your county/city attorney for guidance. Remember, the applicant has the ability to waive the timeline. Given the circumstances and the response from your health and human services professionals, you could always ask the applicant to voluntarily pause the application’s progress, but have them do so in writing.

We don’t have much more to share given the rapidly evolving situation. MAP will continue to research this important issue, and will post more information here when it is available.

UPDATE 3-24-2020

Please see the attached Executive Order issued by Governor Bullock for guidance on meeting statutory requirements in Title 76 of the Montana Code Annotated including in the Montana Subdivision and Platting Act. This was issued on March 24, 2020.
